ART Appeal

If your Australian visa application has been refused or your visa has been canceled, it can significantly disrupt your study, work, or life plans, and bring both emotional and practical stress. The Australian Government provides a legal channel for review through the Administrative Review Tribunal (ART), an independent and impartial tribunal for eligible applicants.

The Administrative Review Tribunal (ART) is a new federal administrative review body officially launched in October 2024, replacing the former AAT (Administrative Appeals Tribunal). As an independent tribunal, ART primarily reviews decisions made by the Department of Home Affairs regarding visa refusals or cancellations.

ART does not reprocess your visa application. Instead, it conducts a merits review, a judicial-like process in which a tribunal member evaluates whether the original decision was reasonable, lawful, and procedurally fair, based on the evidence and relevant laws.

Submitting an appeal within the prescribed timeframe may help you retain lawful stay in Australia and avoid being classified as unlawfully present.

ART can uphold, revoke, amend, or send the original decision back to the Department of Home Affairs for reconsideration.

The tribunal operates independently of the Department of Home Affairs, ensuring a more objective and fair hearing.

Not every visa refusal or cancellation can be appealed. Your refusal notice must clearly state “Merits Review Rights” to be eligible to lodge an appeal with ART.
